SECTION 1: GENERAL TERMS

1.1 PROGRAM DESCRIPTION

Our programs include but are not limited to:
- The Rising Order (16-week container)
- Face Your Dragons (21-day challenge)
- The Brotherhood (ongoing membership)
- Workshops, retreats, and other offerings

All programs focus on masculine development, nervous system regulation, and psychological wound work.

IMPORTANT: Our programs are NOT therapy, medical treatment, or professional counseling. Facilitators are NOT licensed therapists or medical professionals.

1.2 ELIGIBILITY

- You must be 18+ years old
- You must not be in active mental health crisis
- You must be capable of handling emotional intensity
- Application/purchase does not guarantee acceptance (for application-based programs)
- We reserve the right to decline any application for any reason

1.3 ACCEPTANCE PROCESS (Application-Based Programs)

- Submitting an application does not guarantee acceptance
- Interview may be required
- We evaluate applications based on readiness and fit
- We will notify you of decision within 48-72 hours
- Acceptance expires if payment not received within deadline

1.4 ACCOUNT RESPONSIBILITY

If you create an account to access our services:
- You are responsible for maintaining confidentiality of your login credentials
- You are responsible for all activity under your account
- You must notify us immediately of any unauthorized access
- We reserve the right to suspend or terminate access if your account is misused or violates these Terms

1.5 MODIFICATIONS

We reserve the right to modify:
- Program schedules (with reasonable notice)
- Program structure or content
- Facilitators or staff
- These terms (active participants will be notified)

SECTION 2: PAYMENT TERMS & REFUND POLICY

━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━

2.1 PAYMENT

- Payment in full required upon acceptance/purchase
- Payment plans available for select programs (terms specified per program)
- All fees are in USD
- Payment processed via secure third-party processors (Stripe, PayPal, etc.)

2.2 REFUND POLICY - NO REFUNDS

ALL SALES ARE FINAL. NO REFUNDS.

This means:
- Once you purchase or make payment, it is non-refundable
- This applies whether program has started or not
- This applies to full payments and payment plans
- This applies even if you do not attend or participate

2.3 PAYMENT PLANS

- If you are on a payment plan and stop participating, you are still responsible for all remaining payments
- Missed or late payments may result in removal from program with no refund of payments made
- Payment plan obligations cannot be cancelled

2.4 EXCEPTIONS (Deferral Only - Not Refund)

The ONLY exceptions where we may consider deferral to a future offering (NOT refund) are:
- Death of participant (documented)
- Severe medical emergency requiring hospitalization (documented)
- Unexpected military deployment (documented)

Deferral requests must be submitted in writing with documentation. Approval is not guaranteed and evaluated case-by-case.

2.5 DECLINED APPLICATIONS

If we decline your application AFTER you have paid, you will receive a full refund.

2.6 PROGRAM CANCELLATION BY US

If Rise with malcolm LLC cancels a program, full refunds will be issued.

2.7 CHARGEBACKS

Initiating a chargeback will result in:
- Immediate removal from all programs
- Loss of access to all materials
- Potential legal action
- Ban from future participation

SECTION 3: PARTICIPATION REQUIREMENTS

3.1 GENERAL REQUIREMENTS

Each program has specific requirements which may include:
- Live call attendance (schedule specified per program)
- Daily somatic practices
- Small group participation
- Respectful engagement with facilitators and participants

Specific requirements are communicated upon enrollment.

3.2 CONFIDENTIALITY (MANDATORY)

You MUST maintain strict confidentiality regarding:
- Other participants' identities and personal information
- Shares, stories, and vulnerabilities expressed by others
- Program content and proprietary materials
- Private communications within program containers

Violation of confidentiality will result in immediate removal without refund and potential legal action.

3.3 CONDUCT STANDARDS

You are expected to:
- Treat all participants and facilitators with respect
- Engage honestly and authentically
- Honor the container and its agreements
- Take responsibility for your own experience
- Communicate proactively if issues arise

3.4 REMOVAL FOR VIOLATIONS

We reserve the right to remove participants who:
- Violate confidentiality agreements
- Engage in harassment, threats, or disrespectful behavior
- Miss excessive sessions without communication
- Demonstrate active crisis requiring professional intervention
- Fail to meet payment obligations
- Violate any program terms

NO REFUND will be issued for removal due to violations.

3.5 RECORDINGS AND MEDIA RIGHTS

By participating in any program, workshop, event, or service, you grant Rise with malcolm LLC full rights and permission to:

- Record, film, photograph, or otherwise capture your participation, including your likeness, image, voice, name, and content you share

- Use, reproduce, distribute, and display such recordings or media for educational, promotional, or commercial purposes, in any format and across any platform, without limitation

- Create derivative works from such materials

- Use your testimonials, feedback, or results (with or without attribution)

All recordings and related materials are the sole property of Rise with malcolm LLC.

You are not entitled to:
- Compensation for use of your image or participation
- Rights of review, approval, or ownership
- Control over how materials are edited or used

If you do not wish to be recorded or featured, you must notify us in writing before participating. We will make reasonable accommodations where possible.

SECTION 4: INTELLECTUAL PROPERTY

4.1 OWNERSHIP

All content, materials, recordings, curriculum, and intellectual property are owned by Rise with malcolm LLC and protected by copyright law.

4.2 PROHIBITED USES

You may NOT:
- Record or distribute program content without written permission
- Share materials outside the program
- Use content for commercial purposes
- Reproduce, modify, or create derivative works
- Post program content on social media or public platforms

4.3 CONSEQUENCES

Violation may result in:
- Immediate removal without refund
- Legal action for damages
- Injunctive relief

SECTION 5: LIABILITY WAIVER & ASSUMPTION OF RISK

5.1 ACKNOWLEDGMENT OF PROGRAM NATURE

I understand that Rise with malcolm LLC programs involve:
- Emotional and psychological exploration
- Nervous system regulation and somatic practices
- Vulnerability and emotional expression
- Discussion of trauma, wounds, and difficult experiences
- Group witnessing and sharing

5.2 ACKNOWLEDGMENT OF RISKS

I acknowledge these activities carry inherent risks including:
- Emotional distress, discomfort, or activation
- Triggering of past trauma or difficult memories
- Temporary psychological dysregulation
- Physical discomfort during somatic practices
- Relationship strain as I change and grow

5.3 ASSUMPTION OF RISK

I VOLUNTARILY CHOOSE to participate and ASSUME ALL RISKS associated with participation.

5.4 NOT THERAPY OR MEDICAL TREATMENT

I understand and acknowledge that:
- Rise with malcolm LLC programs are NOT therapy, counseling, or medical treatment
- Facilitators are NOT licensed therapists or medical professionals
- These programs do NOT replace professional mental health care
- I should maintain any existing therapy or medical treatment
- I will seek professional help if I experience crisis

5.5 MENTAL & PHYSICAL HEALTH RESPONSIBILITY

I affirm that:
- I am not currently in active mental health crisis
- I am capable of handling emotional intensity
- I am physically capable of participating in somatic practices
- I will communicate concerns or limitations to facilitators
- I take full responsibility for my mental and physical health
- I will seek professional help if needed

5.6 NO GUARANTEES

I understand that:
- NO specific outcomes or results are guaranteed
- Results vary by individual
- Success depends on my engagement and commitment
- Rise with malcolm LLC makes NO promises about life changes
- Testimonials reflect individual experiences, not guaranteed outcomes

5.7 RELEASE OF LIABILITY

I RELEASE AND HOLD HARMLESS:
- Rise with malcolm LLC
- Malcolm Fraser (founder/facilitator)
- All program stewards, staff, and facilitators
- All affiliated entities and individuals

FROM ANY AND ALL claims, demands, damages, losses, liabilities, or injuries arising from my participation, including but not limited to:
- Emotional or psychological distress
- Mental health difficulties
- Physical injury during practices
- Relationship difficulties
- Financial consequences
- Any other harm or damage

5.8 INDEMNIFICATION

I AGREE TO INDEMNIFY AND DEFEND Rise with malcolm LLC and all associated parties against any claims arising from:
- My misrepresentation of mental or physical health status
- My violation of program terms or confidentiality
- My actions affecting other participants
- My failure to seek professional help when needed

5.9 LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW:

Rise with malcolm LLC and its facilitators are NOT liable for any damages arising from participation, including but not limited to:
- Emotional or psychological harm
- Physical injury
- Relationship difficulties
- Financial loss
- Technical issues or platform failures
- Actions or advice of other participants

MAXIMUM LIABILITY (if any): Amount paid for the program.

SECTION 6: DISPUTE RESOLUTION

6.1 INFORMAL RESOLUTION

Any disputes will first be addressed through good faith discussion between you and Rise with malcolm LLC.

6.2 MEDIATION

If informal resolution fails, disputes will be resolved through mediation (costs split between parties).

6.3 BINDING ARBITRATION

If mediation fails, disputes will be resolved through binding arbitration in Wyoming, United States.

6.4 CLASS ACTION WAIVER

You waive the right to participate in class action lawsuits.

6.5 GOVERNING LAW

These terms are governed by the laws of the State of Wyoming, United States.

SECTION 7: GENERAL PROVISIONS

7.1 ENTIRE AGREEMENT

These Terms & Conditions, along with the Privacy Policy, constitute the entire agreement between you and Rise with malcolm LLC.

7.2 SEVERABILITY

If any provision is found unenforceable, remaining provisions remain in full effect.

7.3 WAIVER

Failure to enforce any provision does not waive our right to enforce it later.

7.4 ASSIGNMENT

You may not transfer or assign these terms. We may assign them to affiliated entities.

7.5 AMENDMENTS TO TERMS

We reserve the right to modify or update these Terms at any time, with or without prior notice.

The most current version will always be available at [your website]/terms with the "Last Updated" date reflecting the latest revision.

By continuing to use our services after changes are published, you agree to be bound by the updated Terms.

Material changes affecting active participants will be communicated via email when reasonably possible.

AGREEMENT

- You assume all risks of participation
- You release all liability
- You are of sound mind and legal age (18+)
- This agreement is legally binding
